These Terms of Service (the “Terms”) form a binding agreement between you and Pixlift. They cover how you may access and use the Pixlift website, services, and APIs. Defined terms used here have the meanings given in the relevant section.
Acceptance of Terms
By creating a Pixlift account or using any part of the Pixlift services, you agree to be bound by these Terms of Service and any policies referenced in them. If you do not agree to any part of these terms, you must not access or use the services.
These terms apply to every user of Pixlift, including visitors who interact with public marketing pages, registered users who upload images, and developers who call our APIs on behalf of an organisation.
Description of Service
Pixlift provides AI-powered image enhancement, including upscaling, face restoration, denoising, colour grading, and related capabilities. Specific enhancement modes, limits, and credit costs are described elsewhere on the site and may change as we improve the platform.
We may add, modify, or remove features from time to time. Where a change materially affects how you use a feature you depend on, we will give reasonable notice through the product or by email.
User Accounts
You must register an account to use most Pixlift features. You agree to provide accurate information during signup, keep your credentials confidential, and notify us promptly if you suspect unauthorised use of your account.
You are responsible for all activity that takes place under your account, including activity by anyone you share credentials with. We may suspend or terminate accounts that show signs of compromise or that violate these terms.
Accounts are intended for individuals aged 13 or older. If you are creating an account on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
Acceptable Use
You agree not to use Pixlift to upload, generate, or distribute content that is unlawful, infringing, deceptive, harassing, sexually explicit involving minors, or otherwise harmful. You will not attempt to reverse engineer, probe, scan, or interfere with the integrity or performance of the services.
You agree not to use the services to develop a competing product, to scrape our outputs at scale, or to build training datasets without explicit written permission from us.
We reserve the right to investigate suspected violations of these acceptable-use rules and to suspend, throttle, or terminate access where we determine in good faith that a violation has occurred.
Content Ownership
You retain ownership of the images you upload and the enhanced outputs Pixlift generates from them. We claim no copyright in your content.
You grant Pixlift a limited, worldwide, royalty-free licence to host, process, and display your content solely as needed to operate the services on your behalf — for example, to run an enhancement pipeline, generate share links you create, or surface your jobs in your dashboard.
We do not use your uploads to train AI models. Aggregated, fully de-identified service metrics may be used to improve reliability and performance.
Payment and Billing
Pixlift uses a credit-based billing model. Credits may be included in a subscription plan, purchased as one-off packs, or granted as part of a promotion. The current pricing and credit costs for each enhancement mode are published on the pricing page.
Subscription fees are billed in advance on a recurring basis through our payment provider and merchant of record, Lemon Squeezy, which processes payments and handles applicable sales tax/VAT on our behalf. You authorise charges to the payment method on file at the start of each billing period until you cancel.
Except where required by law, payments are non-refundable. Unused credits in a billing period generally do not roll over unless your plan explicitly says they do.
Failed payments may result in degraded service, suspension, or termination. We will notify you and give you a reasonable opportunity to update your payment method before any such action.
Termination
You may terminate your account at any time from the settings page. On termination, your subscription will not renew, and your stored content may be deleted after a short grace period.
We may suspend or terminate your access to the services if you breach these terms, if your account is involved in suspected fraud or abuse, or if we are required to do so by law. Where practical, we will give you notice and an opportunity to cure the breach.
Sections of these terms that by their nature should survive termination — including Content Ownership, Disclaimers, Limitation of Liability, and Governing Law — will continue to apply.
Disclaimers
The services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Pixlift disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the services will be uninterrupted, error-free, or that any specific enhancement output will meet your expectations. AI outputs are inherently probabilistic and may contain artefacts.
Limitation of Liability
To the maximum extent permitted by law, Pixlift and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising out of your use of the services.
Our total aggregate liability for any claim arising out of or relating to these terms or the services will not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred US dollars.
Governing Law
These terms are governed by the laws of the jurisdiction in which Pixlift is incorporated, without regard to its conflict of laws principles. Any dispute arising out of or relating to these terms will be brought exclusively in the competent courts of that jurisdiction, and you consent to personal jurisdiction in those courts.
If any provision of these terms is held to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be replaced with the closest enforceable equivalent that preserves the original intent.
Changes to Terms
We may update these terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where appropriate, notify you through the product or by email before the changes take effect.
Your continued use of the services after the effective date of an updated version of these terms constitutes your acceptance of the new terms. If you do not agree to the new terms, you must stop using the services.
